These Terms and Conditions are governed by the laws of the Province of British Columbia, Canada and you hereby consent to the exclusive jurisdiction and venue of courts in Victoria, British Columbia, in all disputes arising out of or relating to the use of the Site.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Elements & Insights as a result of this agreement or use of the Site.  Nothing contained in this agreement derogates from our right or obligation to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by us with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision, or portion thereof, will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, with the remainder of the agreement continuing in effect.

IP ADDRESSES AND COOKIES

Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site.

WHERE WE STORE YOUR PERSONAL DATA

All information you provide to us is stored on the secure servers of our hosting agents.

All payment transactions are encrypted and processed through a secure third party payments processor (e.g. PayPal; Square; etc).

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask that you not share the password with anyone.

CANADIAN PERSONAL INFORMATION PROTECTION AND ELECTRONIC DOCUMENTS ACT (PIPEDA)

We have taken the necessary precautions to be in compliance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). Personal information includes any factual or subjective information, recorded or not, about an identifiable individual. The European Commission has confirmed that “Canada is considered as providing an adequate level of protection for personal data transferred from the [European] Community to recipients subject to the Personal Information Protection and Electronic Documents Act” (Decision 2002/2/EC).

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period.

Purchase, Payment, Rescheduling, Cancellation, and Refund Policy

PURCHASES AND PAYMENTS
Unless otherwise stated, all products and services are priced in Canadian (CAD) dollars.

Rates for products and services are subject to change without notice.

Unless otherwise agreed upon by both parties, all consultations are scheduled – and all products are paid for – online, and in advance.

RESCHEDULING AND CANCELLATIONS
Unless otherwise agreed to, all consultations will occur either by phone, online, or in-studio at Elements & Insights. If you wish to schedule an in-person appointment outside of the studio, you agree to inquire prior to scheduling your appointment as to availability, and to permit discussion and arrangement for any applicable travel fees. A confirmed appointment cancelled by you due to a failure to properly inquire as to availability and travel fees may be subject to administration and cancellation fees as described herein.

Clients scheduling an appointment will receive a confirmation email upon receipt of payment. Assuming time permits, a reminder email is sent 48 hours in advance of the appointment, and a final reminder email one (1) hour prior to the scheduled time.

If you do not receive a confirmation email within an hour of scheduling your appointment, you are to contact us immediately through our contact page to let us know. Kindly include your name, appointment type, date, and time.

An appointment may be rescheduled without charge by you with a minimum 36 hours notice. A rescheduling made with less than 36 hours notice may incur a $25 administration fee.

A maximum of two (2) re-schedulings by you per appointment will be permitted, with the third occasion being treated as a cancellation. Cancellation fees may apply, as described herein.

Re-schedulings are currently limited to time and date only. "Upgrades" or alterations to scheduled appointments (e.g. changing from a 40 min appointment to a 60 min appointment, or from an In-Studio to a Skype session)  are unavailable at this time. 

A confirmed appointment may be cancelled by you with a full refund, less a $25 administration fee*, with a minimum 36 hours notice.

Any appointment cancelled by you with less than 36 hours notice is subject to a 50% cancellation fee*.

Any appointment cancelled by you with less than 1 hours notice is subject to a 100% cancellation fee*.

Any rescheduling and/or cancellation must be done by through the email and calendar notification(s) you receive (links will be found at the bottom of the notifications). Communications made by other means (e.g. separate email or via the contact page) cannot be relied upon for the purposes of rescheduling or cancellation.

Any misrepresentation made during the solicitation of a product or service (e.g. providing a fake or inauthentic photo) may, at the sole discretion of Elements & Insights, be treated as a cancellation and subject to a 100% administration, restocking, or cancellation fee.

Aggressive, threatening, confrontational, or other unduly disruptive behaviour during a service will, at our sole discretion, result in the immediate termination of that service. If in-studio, you will be required to immediately vacate the premises. A refund will be issued for any unused time remaining, to a maximum of 50% of the amount paid by you.

Circumstances may require us to re-schedule or cancel an appointment with short notice. In the event of such a cancellation, payments made for that service will be fully refunded, and gift cards/certificates and credits used will be "reloaded" in kind – cancellations made with respect to a "misrepresentation" referred to in paragraph 11 (above) notwithstanding.

*Members in good standing exempt.

REFUNDS
Unless explicitly stated otherwise (e.g. the Cancellation Policy), consultations and other services are offerend on a non-refundable basis.

Due to the nature of digital products, no refunds will be offered on those items at this time. All sales are considered final.
